SUBJECT: Council Resolution no. 104 of 29.12.2010 .-

City Council of 18.01.2011

; Call for school meals .-

La sottoscritta ANGELONE Sonia, capogruppo della “ Lista Civica Sviluppo e Solidarietà”   a nome dei componenti di minoranza,

PREMESSO CHE

A.     

1.      nel Consiglio Comunale del 18.01.2011 fu portato all’Ordine del Giorno – esattamente al punto 4) – la conferma della delibera di Giunta n°. 104/2010 contenente “ approvazione proposta Società Daniel per gestione Servizio Finanziario Comunale 2011” ;

2.      Con nota del 18.01.2011 indirizzata alla S.V. e ai componenti della Giunta, e consegnata al Segretario affinchè fosse allegata al verbale di deliberazione del Consiglio, fu contestata da parte della minoranza la legittimità di dell’atto di Giunta n°. 104/2010, in quanto – è bene ricordarlo – violava:

• Gli artt.3,20,21,53,54,55,56 e 57 del D.Lgs. 163/2006;

• Article. 1 of Law 12/79;

• Articles. 20.27 and 29 of Legislative Decree no. 276/2003

3. Faced with such observations, the SV arranged to suspend the debate and vote on this agenda item, even with the grievances of the minority who abandoned the courtroom in protest ;

4. After two days the SV called on the Municipality signed in order to have more explanations Convention regarding the subject of the dispute and there "promised" (docet sailors!) to find a solution.

WHEREAS

E 'spent nearly a month by the City Council;

WHEREAS

Company Daniel continues - even in the absence any act of deliberation - to carry out its activities on behalf of the City

WHEREAS

To date the undersigned does not has been notified of any act of termination of the agreement with the Company Daniel, nor such extension

WHEREAS

To date, the website of the municipality of Castelvecchio Subequo - praetorian register section - are not published deliberative acts on each other. (The last act was published at no. 10 chronological order and the notice about the update of the Register of municipal tellers - posted 21/01/2011 ending on 02.05.2011)

The great respect that goes to the opposition that is giving an example of the spirit of endurance and, let us say, respect to the municipality, but we would not be singled out as "fools"

NOTICE

The SV to want to deliver or send to the parent who signed the minority - within days. 3 (three) from the date of receipt - the minutes of the Municipal Council's resolution of 18.01.2011.

The above to be forwarded to the Prosecutor the Republic of Sulmona and the Court of Auditors for the evaluation of their competence.

B.

WHEREAS

On the website of the municipality of Castelvecchio Subequo - praetorian roll - was published at no. 136 On 12/02/2010 a notice of invitation to tender for the contract for the supply, preparation and serving of meals to pupils in nursery, elementary and middle of the Municipality for the period January 2011 - 30/06/2013;

NOTICED THAT

the notice has been rightly referred to the Legislative Decree no. 163/2006, under which it was not considered to apply to the agreement with the Company Daniel

The timeliness ban in less than thirty days before the final race of such importance made

WHEREAS

alerted 17.12.2010 prot. no. 4392 the tender referred to above has been canceled due to "inconsistencies in 'notice and the tender notice"

WHEREAS

of today is not banned other tendering, deliberation or renewal even this might not legitimate, with the previous company

SINCE

Students continue to enjoy the meal (it's a simple deduction, are not addressed with their parents!)

Any renewals were not delivered to the undersigned nor published on the website of Common

WHEREAS

Any renewals (exceptionally) be made in writing (unfortunately when you have to do with public affairs are not worth the handshakes of our grandparents!)

NOTICE IS FURTHER

The SV to want to deliver or send to the parent who signed the minority - within days. 3 (three) from the date of receipt - copy of the deliberation with which it has been extended to the custody of the school meals service Soc COSELP Pratola Peligna.
